Prestige Custom Building & Construction, Inc. ("Prestige," "Company," "we," "us," or "our") is a luxury design-build firm founded by Lior Golan, serving Long Island, New York, including Nassau County, Suffolk County, and surrounding communities. We provide residential construction services including custom home construction, home renovations, additions and dormers, residential architecture, and interior architecture.

All construction services are governed by separate written contracts executed between the homeowner and Prestige Custom Building & Construction, Inc., in accordance with the New York Home Improvement Contractor Act (Article 36-A of the New York General Business Law) and all other applicable state and local regulations.

03Use of the Website

05No Contractor-Client Relationship Created

A formal contractor-client relationship with Prestige Custom Building & Construction is established only upon execution of a written construction contract or professional services agreement signed by Lior Golan or another authorized representative of the Company, in accordance with the New York Home Improvement Contractor Act (Article 36-A of the New York General Business Law). All construction work, design services, project timelines, budgets, and deliverables are governed solely by that written agreement - not by these Website Terms of Service or any content displayed on this Website.

Do not rely on any content displayed on this Website - including project descriptions, process descriptions, portfolio images, cost references, or timeline information - as a substitute for project-specific professional advice tailored to your particular property, scope, budget, or conditions. Every construction project is unique, and accurate information can only be provided through a formal consultation and written agreement.

06Construction Documents & Project Deliverables

All project deliverables produced by Prestige Custom Building & Construction - including but not limited to architectural plans, construction documents, 3D models, photorealistic renderings, material specifications, and budget documentation - are professional work product prepared for specific clients under formal written agreements. The following terms apply:

6.1 Ownership of Work Product

Unless otherwise specified in a written agreement, Prestige Custom Building & Construction retains ownership of all original design work product, including 3D models, rendering files, design concepts, construction methodologies, and proprietary processes. Clients receive a license to use completed deliverables solely for the specific project for which they were prepared.

6.2 Modifications and Reuse

Clients, contractors, architects, and all other parties are prohibited from modifying, altering, or reusing project documents - including architectural plans, construction drawings, and 3D models - for any project other than the specific scope for which they were originally prepared, without prior written consent from Prestige Custom Building. Any unauthorized modification or reuse releases the Company from all liability associated with the modified or reused documents.

6.3 Record Retention

Prestige Custom Building retains copies of all project documentation for a minimum of seven (7) years following project completion, consistent with applicable statutes of limitations and professional requirements under New York law.

07SMS/Text Messaging Terms

Prestige Custom Building & Construction may offer an SMS/text messaging program to communicate with clients and prospective clients. By opting in to receive text messages, you agree to the following terms in addition to all other provisions of these Terms of Service. For full details on how we collect, use, and protect your information in connection with our SMS program, please refer to Section 8 of our Privacy Policy.

7.1 Types of Messages

If you opt in, you may receive text messages related to:

• Appointment and scheduling reminders: reminders for upcoming consultations, site visits, and design meetings

7.2 Message Frequency

7.3 Opt-Out

Upon receiving your opt-out request, we will confirm your removal and cease sending further text messages within ten (10) business days, as required by the Telephone Consumer Protection Act (TCPA).

7.4 Message and Data Rates

Message and data rates may apply. Check with your carrier for details regarding your text messaging plan. Prestige Custom Building is not responsible for any fees or charges imposed by your mobile carrier in connection with text messages you receive from us.

7.5 Carrier Liability

Carriers are not liable for delayed or undelivered messages. Prestige Custom Building makes reasonable efforts to ensure timely delivery of text messages; however, delivery is subject to the capabilities and performance of your mobile carrier and network conditions beyond our control.

7.6 Age Requirement

You must be 18 years of age or older to use this SMS service. By opting in to receive text messages from Prestige Custom Building, you represent and warrant that you are at least 18 years of age.

You hereby irrevocably consent to the personal jurisdiction and venue of those courts and waive any objection to the laying of venue of any such proceeding.

15Dispute Resolution

15.1 Informal Resolution

Before filing any formal claim, you agree to contact Prestige Custom Building & Construction in writing at [email protected] and attempt in good faith to resolve any dispute, claim, or controversy arising out of or in connection with these Terms or your use of the Website. We will attempt to resolve the dispute informally within thirty (30) days of receiving written notice.

15.2 Binding Arbitration

If informal resolution is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered in Nassau County, State of New York, in accordance with the rules of the American Arbitration Association (AAA), except as modified herein. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

15.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated on a class action basis or in a representative capacity.

15.4 Exceptions

Nothing in this Section shall prevent either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm or protect intellectual property rights pending resolution of a dispute.

15.5 Construction Services Disputes

Disputes arising from the performance of construction or design-build services are governed by the dispute resolution provisions of the applicable written construction contract - not by this Section. This Section applies exclusively to disputes arising from your use of the Website. In the event of any conflict between these Terms and a signed construction contract, the construction contract shall control.

16Modifications to These Terms

Prestige Custom Building & Construction reserves the right to modify, revise, or update these Terms of Service at any time, at our sole discretion. When we make material changes, we will update the effective date displayed at the top of this page and, where appropriate, provide notice via a prominent posting on the Website.
