All construction services are governed by separate written contracts executed between the homeowner and Prestige Custom Building & Construction, Inc., in accordance with the New York Home Improvement Contractor Act (Article 36-A of the New York General Business Law) and all other applicable state and local regulations.

3.1 Permitted Use

All project deliverables produced by Prestige Custom Building & Construction - including but not limited to architectural plans, construction documents, 3D models, photorealistic renderings, material specifications, and budget documentation - are professional work product prepared for specific clients under formal written agreements. The following terms apply:

6.1 Ownership of Work Product

Unless otherwise specified in a written agreement, Prestige Custom Building & Construction retains ownership of all original design work product, including 3D models, rendering files, design concepts, construction methodologies, and proprietary processes. Clients receive a license to use completed deliverables solely for the specific project for which they were prepared.

6.2 Modifications and Reuse

Clients, contractors, architects, and all other parties are prohibited from modifying, altering, or reusing project documents - including architectural plans, construction drawings, and 3D models - for any project other than the specific scope for which they were originally prepared, without prior written consent from Prestige Custom Building. Any unauthorized modification or reuse releases the Company from all liability associated with the modified or reused documents.

6.3 Record Retention

Prestige Custom Building retains copies of all project documentation for a minimum of seven (7) years following project completion, consistent with applicable statutes of limitations and professional requirements under New York law.

Prestige Custom Building & Construction may offer an SMS/text messaging program to communicate with clients and prospective clients. By opting in to receive text messages, you agree to the following terms in addition to all other provisions of these Terms of Service. 7.1 Types of Messages

15.5 Construction Services Disputes

Disputes arising from the performance of construction or design-build services are governed by the dispute resolution provisions of the applicable written construction contract - not by this Section. This Section applies exclusively to disputes arising from your use of the Website. In the event of any conflict between these Terms and a signed construction contract, the construction contract shall control.

Prestige Custom Building & Construction reserves the right to modify, revise, or update these Terms of Service at any time, at our sole discretion.
